Interestingly, two other stories related to ChatGPT came up this past week or so:
A lawyer used ChatGPT as a legal research tool, and it invented legal authority for him. As you can imagine, he’s now in some trouble with the court:

When asked to describe a particular existing lawsuit, ChatGPT invented claims against an unrelated person for embezzlement. That individual is now suiting ChatGPT for defamation. I don’t have an article for that, but this video discusses it:

ChatGPT cannot be sued! It’s a program, not a person. I suppose the litigation is against Open AI.

It actually is, though most of the reporting is saying it’s ChatGPT. But with that said…
“Should not be sued,” I’d agree. But there’s a long history of lawsuits against bogus parties. One of my favorites is United States ex rel Mayo v. Satan and His Staff, 54 FRD 282 (W.D. Pa. 1971):

Of course, that lawsuit wasn’t successful, but it didn’t stop the plaintiff from bringing it.
